These Terms of Service ("Terms") govern your access to and use of the Pokesensor desktop application and the website at app.pokesensor.org (together, the "Service"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Pokesensor is a desktop application that reads hardware sensor data from the device on which it is installed and displays it locally. The Service is provided for personal and internal business use.
2. Accounts and memberships
Some features ("VIP") require a paid membership. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Memberships are billed on a recurring monthly or annual basis through our payment processor until cancelled.
3. Acceptable use
You agree not to: (a) reverse engineer, decompile, or attempt to extract the source code of the application except to the extent permitted by law; (b) resell, sublicense, or redistribute the Service without authorization; (c) use the Service to violate any applicable law; or (d) interfere with or disrupt the integrity or performance of the Service.
4. Intellectual property
The Service, including all software, text, graphics, and logos, is owned by Pokesensor and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.
5. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that sensor readings are accurate, complete, or suitable for any particular purpose, and you should not rely on them for safety-critical decisions.
6. Limitation of liability
To the maximum extent permitted by law, Pokesensor shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, hardware, or profits, arising out of or related to your use of the Service.
7. Termination
We may suspend or terminate your access to the Service at any time for any violation of these Terms. You may stop using the Service at any time. Provisions that by their nature should survive termination will survive.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be reflected by the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
